WHO IS RESPONSIBLE WHEN A TREE FALLS ON YOUR PROPERTY IN NSW

December 17, 2021 | Posted by Jake Cubis | in Tree Care, Tree Removal, Tree Services

Trees and branches can fall due to harsh weather, human error, or the simple passage of time – and when this happens, it can cause substantial damage to the property below. This goes beyond falling leaves clogging up a drain; this could lead to life-threatening injuries and immense repair fees. In this article, we will look at the factors that impact who is responsible when a falling tree damages your New South Wales property.

1. The location and health of the tree

One core factor in assigning responsibility is where the tree itself is – it might be a neighbour’s tree, for example. In this case, if the neighbour neglected to trim the old or dying tree, they may be legally at fault for the damage done to your fence or roof.

This is not guaranteed, however: it must be in a dangerous condition, or else authorities may see it as an act of God with no direct blame. If this happens in a storm, this complicates the matter further.

2. The conclusions of the court

Under the Trees (Disputes Between Neighbours) Act of 2006, New South Wales citizens can take neighbours to the Land and Environment Court to make them trim the tree before it does any damage or to sort out liability and compensation for a fallen tree.

For the latter claims to be successful, the tree must:

  • Cause more than just minor or cosmetic damage.
  • Be a direct (but not necessarily the sole) cause of the damage.
  • Be evidently unhealthy or at risk of causing damage.

3. Your insurance policy

If you have building or home insurance, then you might be able to remove your own fallen tree and cover the damages. However, under many of these policies, you can only remove the tree for free if it has damaged your property. The exact wording of the policy is paramount in determining who is liable, but generally speaking, it is only a matter for your insurer there is damage involved.

Boundary fences are technically part of both your property and your neighbour’s – if a tree damages this, then both sides could find themselves 50% responsible for the repairs, regardless of who owns the tree.

Determining responsibility can be tricky in the aftermath of a fallen tree, which is why it is important to have problematic trees cut down when and where possible. Taking care of your garden is like maintaining a living work of art. Among the most important strokes on this natural canvas are your trees and hedges. But how often should they be pruned or trimmed to keep your outdoor masterpiece looking its best? In this blog, we'll guide you through the essentials of tree and hedge maintenance. The Importance of Regular Tree Pruning in Preventing Tree Removal Regular tree pruning is not just about aesthetics; it's a preventive measure that can save you from the costly and often disruptive process of tree removal. Professional Tree Services offer routine pruning and maintenance to keep your landscape looking lush, green and clean. Our team of qualified arborists ensure your trees are healthy and well-maintained, reducing the risk of disease and potential hazards. When Tree Removal Becomes Unavoidable While regular pruning and maintenance can go a long way in preserving the health of your trees, there are instances where removal is the only viable option. Let's look at some of these scenarios: Hazardous Trees: Sometimes, a tree becomes a safety risk and must be removed. Diseased Trees: Despite regular maintenance, some trees contract diseases that are beyond treatment. Property Damage: Trees with invasive roots can cause structural damage, necessitating removal. We are equipped to handle these scenarios safely and efficiently, offering services like stump grinding to ensure a clean finish. Seasonal Considerations for Tree Pruning and Removal The timing of your tree maintenance isn't just a matter of convenience; it's crucial for the health and longevity of your trees. Here's a seasonal guide to help you plan your tree care activities: Spring Ideal for pruning most trees as they are in their growth phase. This is when new buds are forming, making it easier to shape the tree for the year ahead. Summer A good time for removing dead or diseased branches. The trees are in full leaf, making it easier to identify problem areas that need attention. Autumn Avoid pruning; trees are preparing for winter. This is a time when trees are conserving energy and resources, making it less ideal for any form of cutting or trimming. Winter Optimal for tree removal; less impact on the surrounding vegetation. The dormant season minimises stress on the tree, making it a more suitable time for major work like removal. We offer you year-round services to help ensure your trees are well-cared for, no matter the season. Cost Factors: Balancing Tree Pruning and Tree Removal Expenses Investing in regular tree pruning not only enhances the aesthetic appeal of your property but can also be a cost-saving measure in the long run. Compared to the significant expense and disruption of tree removal, routine maintenance is a more budget-friendly option.
